Whose fault would it be if you got hit by the bike while your light is green? |
I saw two people crossing the street while the light was no longer green. One car almost hit them. In this case, if these two people did get hurt because they ran through the red light, should the driver be responisble for their injury? What does it say in the law? I got hit by a man with a bike the other day. He said to me if I called the police, I would be responsible for his injury. He was the one who ran through the red light, and there was no one for me to see him coming through since I was waiting at the traffic light, and the light just changed and I was about to go. He broke my power mirror, and I have to fix that myself, and he threathened me asking for money as well. Is that true that even if the pedestrians do not obey the law and cause the accident, the driver(with the car) always have to be responsible for the accident? Is there a way to defend yourself if truly the fault was caused because of the careless bike rider or pedestrians? Please advise. Thanks! A bicyclist is treated just like a car (a vehicle). Vehicles are supposed to yield to pedestrians when possible, but if the pedestrian breaks the law and the vehicle driver didn't, then the pedestrian is responsible. They too have to abide by the rules of the road too...... Just because the other party violated a traffic law does not automatically relieve you from liability. Just because the other party is a pedestrian or bicyclist does not make you automatically liable. You are required to drive in a reasonable manner, which means you must act to avoid collisions if you can reasonably do so. If the bicyclist rode into your path, but you were 100 feet away and still hit him, you would have at least partial liability for his injuries, because had you been driving reasonably you could have stopped in time to avoid the collision. If the pedestrian suddenly, without warning, jumped in front of your moving car, so that you had absolutely no time to react, then you would not be liable for the pedestrian's injuries. |
