Police choked my brother for nothing!!!? |
My brother is 26, and he just got a motorcycle not too long ago. Well someone thought they'd be funny and jump on it and take off. The cops see this person speeding on the bike and go after them, the person panics and jumps off the bike in front of my brother's house, then takes off running. My brother runs for the bike, to catch it, so it doesnt wreck. The cops tell him they need the bike because it was part of a felony. He lets them take it, and walks down the street to calm his anger. A caucasion cop, (We're African American) rolls beside him and wants to talk to him. My brother tells him there's nothing to talk about, because they already have the bike. The cop then accuses my brother of being drunk. (He had 1 beer). DOes NOT give him a breath-a-lizer test, but chokes him and puts him to sleep, handcuffs him, puts him in the car, takes him to jail, and his bond is set at $500. This was in a tiny town in KY, that is very prejudiced. We have to go beyond this town. What can we do??? First write everything down in as much detail as you can. Photo any bruises or marks. Have your brother write everything down in as much detail as he can. Do the same with any witnesses that will coperate. If they won't get their names and keep a list of witnesses. Write a public records request for ALL police reports on the incident. Get the names of any cops that were there. File a complaint with the police chief and city counsel. You can also write a letter to the local paper but you may want to wait on that until you see how they react to the complaint. Contact a lawyer and ask him for the website for KY lawyer referal because you want one the knows civil rights law. Ask around and see is anyone else has had problems with this cop. Did they file complaints? If the chief seems real that he will do something (keep in mind he may be lying like they did to me) wait to see what will be done. If not enough then I would mail the letter to the editor. Ask the lawyer if you can record conversations in KY with out the knowledge of everyone in the conversation. In WI you can. If you can in KY tape all phone and face to face conversations with the cops. Be sneaky. Say stuff about the choking in a very meak way. See if the cop or the chief responds with acknowledgement of the facts you state. If you know about other corrupt behavior mention that too. Almost forgot. Always state the time and date on the tape including year. (my case is 6 years running now) Mini tape recorders are fairly cheap. 50$ If it is illegal to tape this way a cam corder will work. When you talk to the chief just set it on his desk and say I have a very bad memory and I can't write very fast so this is for my records. Keep in mind that in a small town with redneck cops you can expect retaliation. The ACLU i found to be toatlly worthless. The FBI has a civil rights squad and cops fear that. The FBI will investigate you for filing the complaint to make sure it is real so be prepared for that. Mail them the detailed statements you wrote down first and the police reports and witnesses statements or names, same with ACLU. I should also mention that you need to keep copies of everything for your records. The lawyer may disagree with some of thsi but that is what I did. Eventually I actually had to write up 400 one page fliers asking people to contact me with stories about police corruption and I handed them out to people on sidewalks during my hometowns parade. A good rule of thumb is that in court the word of one cop equals three people that have never been convicted of a felony. that is not fair but it how it is, and good ole boys stick together. It would be a big huge waste of time because thats how the government is set up. So even if it was true and the cops are at fault, all you can do is forget about it. Thats America for you! Many cops are sadistic psychopaths who would be in prison themselves if they weren't wearing badges. Let me see a stolen bike is found in his front yard, of coure he will be a suspect and can't just walk off, white or black he is going to be questioned as to what he seen. And your brother gets smart with the officer, ( ever though he should have been nice and tried to help) And he would not choke and put him to sleep, police don't do that, they may tazer, they may mace, or they may beat him with a ASP, but they don't choke. so what you are saying is your brother resisted and was arrested using force and now instead of being a good witness working with the police, he is in a jail, tell me who has the problem ?? They should have just clubbed him, stop whining Were there witnesses?If so : GO TO A LAWYER AND SUE SUE SUE!!!!!!!! Don't Let those Pieces of poo get away with that!!!!!! I am white! |
