Who's at fault in this situation? |
Yesterday I saw a man on a bike get hit by a car. Not too hard but hard enough to make him fall on the ground. See the person driving had a green arrow and was making a left turn. The guy on the bike was crossing the intersection at the same time. After it happened the guy grabbed his bike and rode off like nothing happened! And the person driving the car just sat there for a few seconds, then drove off... So if the guy on the bike would have stayed around, could he have pressed charges..or could the person driving since the guy shouldn't have crossed the street at that time? Nope, the car had a "green arrow" which means it is a protected left turn. There should be no oncoming traffic or pedestrians because their lights will be red. The bicyclist was at fault because he did not have the right of way. The bicyclist is treated no differently than the traffic heading in the same direction that he is, whether he is on the sidewalk or not (which he shouldn't be). In fact you can assume that if he did get hit and injured and the police came, then the bicyclist would be accused of either running a red light, disobeying the car's right of way, or jay walking (but on a bike). the zoo If the car had the green arrow the bicyclist was wrong. I think if the guy driving had the green arrow, he had the right to make the turn. The guy on the bike, was wrong. That's more than likely why the guy on the bike grabbed his bike and left.. He felt lucky he was able to to that. (grab the the bike and leave.) The guy on the bike was J biking. No way was the man in the car in the wrong..He had the green arrow. The man on the bike should have yielded to the auto. I drive, so I know. Both faults. and accident. Both of them should be more careful. unfortunately here in CA at least, it doesn't matter who has the right-of-way. the law says you must give up your right-of-way to prevent an accident. so yes, the bicyclist could have pressed charges irregardless of his responsibility in the situation. |
