In South Carolina what counts as a motor cycle? |
I want a pocket bike and it has a 49cc engine and goes 45 mph is it street legal? You will probably need a class M driver's licence as it is too fast to be considered a moped. It'll probably have to be insured as even in the state of South Carolina golf carts have to be insured, so I'm sure it would have to be as well. The following is the deffinition of a "moped" in South Carolina... SECTION 56-1-1710. Meaning of "moped". For purposes of this article, "moped" means a cycle with pedals to permit propulsion by human power or without pedals and with a motor of not more than fifty cubic centimeters which produces not to exceed two brake horsepower and which is not capable of propelling the vehicle at a speed in excess of thirty miles an hour on level ground. If an internal combustion engine is used, the moped must have a power drive system that functions directly or automatically without clutching or shifting by the operator after the drive system is engaged. " If it doesn't fall into the above class of vehicles, it's probably classified as a motor cycle, and therefore, you need to be licensed as motorcycle operator and insured as such, or else not drive it on public roads.
