If you're speeding 43 over the limit and charged with (only speeding )by the officer? |
will wreckless driving be added in court (what other charges) 98 in 55 on a sports bike If the cop only gave you a speeding ticket, why are you going to court? Just pay the fine and laugh your way home! Why risk talking to a judge? I was doing 78 in a 45, and I didn't get wreckless driving when I went to court. I was on a Harley. This completely depends on your state laws. In my state, wreckless is not an automatic add on, but we have severe penalties for going that much over the speed limit on motorcycles. The new penalty enhancer law was passed in my state after a State Patrol helicopter clocked a sports bike going more than 200 miles per hour last year. Each state varies about adding new charges in court.... HOWEVER. Nowhere in this great country can they add a charge after you've paid the fine. If you have the option of pleading guilty by paying the fine and avoiding court then TAKE IT! Once they have taken the money for your infraction, they cannot under U.S. constitution change the charge. It's covered under double-jeopardy rules that say: If an agent of the court (clerk) accepts your plea and your sentence is served (you pay the fine) you cannot be re-charged for the crime... ever. they would have to catch you at it again to charge you with another crime. (P.S. In my state speed alone is insufficient grounds for reckless driving charges. There must be other factors involved that endanger the safety or property of others. But don't ell anyone I said that.) I'm a cop and a bike rider. Fresh out of the academy and law refresher. |
