Is a 49cc scooter considered 50cc and does it need insurance? |
My friend received a ticket on his scooter for no registration and no insurance. In Las Vegas the regulation states that any scooter over 50cc must meet these requirements. His is 49cc, and we are confused as to what the requirements are. Here in Florida I have a 49cc scooter and I dont need insurance. I know here I have to register it every year and have a tag on it. I don't know how some laws are out there but here they enforce it here. I also have to wear eye protection and a helmet if no medical insurance. You could probably go to court and argue that it was only a 49cc scooter, and not a 50cc scooter. Most people say that a 49cc scooter will be a 50cc scooter. My dad told me that in most states, the scooter must be registered, otherwise you would receive a ticket. This seems to be the case in your situation, but as it is only a 49cc scooter you could probably get past the ticket. In Nevada, neither registration or insurance is required if the engine displacement is under 50cc. Submitting the scooter Certificate Of Origin (also called an MCO) as evidence should be sufficient for dismissal. |
