I got hit by a car while on a bike and I have a few questions...?



I was on the left side of the road and a car pulled out in front of me so it could turn right onto the road. I thought she saw me so I kept on going but it turned out she didn't even look my way so she turned into me. I flipped over her car and landed on the other side. She got out and said she was sorry and said she'd pay for my bike and gave me her contact information. A police officer drove me home as she went to work. Is that partly my fault that I was hit?

We noticed my bike wheel was bent and my seat was too so we got a replacement wheel and seat and as we were putting them on I noticed there was a crack in my frame. This crack means my bike is trashed and I cannot ride it anymore. We feel bad asking for her to pay for my whole bike so we didn't, she is a college student.

What should I do? If I ended up getitng a new bike I would prefere it to be a road bike instead of a hybrid bike. Should we just try to buy a new frame? should we ask her to pay for it? what?

her insurance should pay for it what did the police report, who's fault was it
I would have got myself a lawyer...the girl has car insurance and they would pay you for your injuries(if you had any) and the bike.
What's odd to me is that a police office drove you home...and he didnt fill out a police report? You would need that for the insurance.

Call the police department and see if it's too late to fill out an accident report.

You were at least partly at fault by riding on the wrong side of the road. When drivers are pulling out to make a right turn, they only look to the left. You should have anticipated her pulling out in front of you and slowed down & be prepared to stop. I think she was very generous offering to pay for your bike. Since you were riding on the wrong side of the road, her insurance might fight the claim.
left side of the road? legally always ride in the right lane of the road as " far to the right as is safely possible" ie: you can ride in almost in the middle of the road if its gonna keep you from being doored. but if you were in the left lane riding against traffic you were in the wrong..sorry
If you were on the left side of the road, then you may be at fault depending on the motor vehicle laws in your location.

Since you already have settled by asking her to come up with the wheel and seat, going back for the frame will seem a bit fishy.

Also, it sounds like you don't have a police report, (despite the officer driving you home) this is something that you will need to go after your compensation with insurance companies.
Try to get the police report, if you can well then possibly you can recoup some cash for the frame.

Report it to the Police. (Not essential but best.)

Get an estimate for the repair cost.

Spend the cheque on whatever you want.

The motorist is lucky to get off with the cost of a new bike and not lst earnings, time etc.
