Can i claim for a compensation if I fall from the bike when riding on a defective pavement ? |
I was riding slowly my bike on a pavement in a residential road in Wales, when I put the wheel on an apparently closed manhole, but the cover was not fixed and my bike felt into the opening and i crashed into the pavement麓. i broke my left arm. the police came and said that i should not use the pavement to ride bike. can i still claim for money because of missing road maintenance? You're not allowed to ride on the pavement - you should have been on the road! Your compensation is not being fined!! I sincerely doubt it. Who knows though? don't think you have a leg to stand on my friend! You should be on the road anyway! Not likely, at least not on the first try. Here is what applied in a situation I was involved in: (This was in Chicago. It may be different where you live.) After reporting the incident, provided the "defect" is a real one (like a pothole, not a crack) the city is obligated to make repairs to the pavement. If you then experience another incident at the same site within a "reasonable" amount of time (which again, would likely vary depending on where you live), you are then entitled to compensation. If you're riding somewhere you're not supposed to, then you're probably screwed. It's not impossible that you're still entitled to some kind of protection however, so you could give it a shot. Get over it. Wear safety gear and learn to ride properly. People need to take responsibility for themselves and stop blaming others. You are not allowed to ride on the pavement. This annoys me more than anything - ride your bike in the road in future. Pavements are for people. I'm sorry you fell off - but I sincerely hope you don't get any compensation. You should not have been on there in the first place. no way, i daresay there was a sign saying no bicycles |
