Can a cop set up his speed trap around the bend in a road while sitting a few feet into a side street? |
i was driving down a road in cali. when i was pulled over by some cop on a bike said i was speeding the thing is he was around the bend in the road and sitting about 5feet into a small side street so i didnt see him until he flashed his lights on me so my question is can i fight the ticket and win or should i just pay it and forget about it? If he was around the bend . Than you should have slowed down in order to negotiate the bend. Most curves or bends have advisory speed , usually 10-20 MPH less than the stated speed of the road . This is only an advisory speed and if you were given the ticket based on the advisory seed alone , then you may be able to fight it , as you are only limited to the speed limit of the entire section of road which you are traveling . You play, you pay! They can set up a speed trap where ever they want. You shouldn't have been speeding. admit it and pay if you have actually sped. i do not see how wrong it is to set speed trap that way. after all, he's only doing the enforcement work. this is the case unless california has separate rules regarding where speed trap may be set up. besides, will it be worth it to go through the whole trouble of disputing it? i wouldn't. They can sit anywhere they want to. You were speeding and got caught so I would just pay the ticket You got caught fair and square. Pay the fine. Or you could go to traffic court and pay the fine plus court costs plus the cost of the cop's time to show up. Major money. It's not a speed trap if you can see them and correct your wrong hoping they won't catch you. You can try to fight it, but that's got nothing to do with what they do. In FL there's a few towns with billboard warning signs that tell you you'll be going into a speed trap area ... another says its not a speed trap it's for your protection! |
