Is the other driver liable when they run someone off the road?



I was in a motorcycle accident just a few days ago. The driver of the car didn't see me and ran me off the road. Is his insurance going to pay me for damages and injury even though he never made contact with me or the bike? I have witnesses that are part of the accident report that are in my favor.

Some thing of that nature is very hard to prove in a court of law especially since he made no physical contact with you. If you have witnesses who say that this drive truly indeed force you off the road with intent, yes then you can sue for damages as long as the witnesses are credible.
If you have witnesses then your safe...he will have to pay
He will definitly haft to pay, especially if you called the police and got a licence #!

This is quite common. As a rider, you learn to anticipate situations like this and be ready to take evasive action even before it's needed. You will have a hard time proving fault. EVERYONE makes mistakes while driving, even me, surprise, surprise.
It's my understanding that whoever caused the wreck is liable.
