5 months ago I was leaving a parking lot and there was a SUV blocking my view so I pulled out to make sure no cars were coming. A bicyclist hit my front right tire. It bent her wheel. The police came and did a report and citied her for riding on the sidewalk and riding on the wrong side of the road. I was NOT citied. My insurance says that I am 50% at fault!! The only damage to my car was the right drivers side right wheel wall was stratched up (no damage). Does this sound right??? thanks! Nope not fully right Challenge your insurance company's findings. Don't accept that you were at fault. i don't think so it sucks and you should appeal the only problem is that you should have wated untill the SUV was out of your way so you did not have to block the side walk. It all depends on the state you are in and the laws but i know in CA the oficer could have actualy said it was 50% your fault but he was nice enough not to and because he did that you insurance should not charge you and if the deny your appeal you should switch insurance. just wondering do you have AAA insurance, because they have done similar things to me If the cyclist hit u and u were already driving (had the right of way) then it isn't your fault at all, it's the cyclist that was riding on the wrong side of the road and bumping into your front tire. a bicycle is a vehicle and therefore must obey the rules of the road. The cyclist should have been on the road. If the SUV was parked then the organization responsible for the parking lot would probably be liable. |
