If a 14 year old was riding a bike and was nearly on the sidewalk...? |
....on the left side of the road for the oncoming car, and they had to turn left towards the curb when they hit him and he flew over the car, would you say that it was probably intentional? Then one would have to figure out who the people were and if they even knew the kid or if it was just because he was a different color or something, right? Was the car traveling the same direction as the 'kid',? you said they had to turn left, if they were stopped before turning to say let on coming traffic pass and then turned, maybe they never saw the 'kid'. If they were traveling in the same lane as the 'kid', going in opposite directions and the car turned Right, in front of the kid, their is no excuse, it would be impossible to guess what the car driver was thinking, regarding a racial issue, In either case, what the driver did was wrong, it was a hit and run, and if the kid had just a small cut, it would be classified as a injury accident. a hit and run with injuries is a felony, and if caught the driver is in deep trouble. Most people don't intentionally hit kids with their cars. Sometimes accidents happen - even to people of a different color. thats messed up,,for one,,color should not be an issue,,,hell iam white as a cracker,,,u should not hate cause of color,,and being a driver and a notary,,,i beleive that bikers have the right of way,,regardless,,,if a car hit him that hard on the side walk,,,they dont need to drive,,,,my question would be why was the car heading to the side walk any way..either they were haters,,,or drunk,,(we dont arrest drunk drivers in s.c.thats b.s.)...or just plain stupid.... well it really does not matter where a person is riding the bike. realistically you could be in the middle of the road and if a car hits any one on a bike the police would/ or should do something. but in most cases if it is a hit and run (with out a death) then police really don't have much that they can do unless you can ID the driver or car, or if there was a bystander who saw what happened. people always have the right of way no matter what. I wish you the best of luck and i hope you finde out who did it. I'm going to have to disagree with FFCarlos. Bicyclists are NOT pedestrians and are bound by the same rules of the road as cars. In the example you cited (assuming this happened in the United States), the 14 year old was not taught to ride on the right side of the road. This of course is not an excuse to take out a bicyclist. Personally, I don't see race as any kind of an issue in this case. I agree with the two above though according to law pedestrians have right a way while in cross walks, though there is no specific law determining that a cyclist is considered a part of traffic or a pedestrian which is why most state and city roads have a specific driving lane for cycling, but they also have to obey standard state laws. There is more information needed to determin who was right or wrong in this situation, was it at a four way stop did the cyclist stop did he stop before the car or did he keep going and not pay any attention to other traffic, or was it the car that didn't pay attention and hit him, did the car leave the site afterward, it they left it may of been intentional, or the driver may of been scared and ran, there is a lot more I can add though it would take too long for me to add everything that comes to mind. Before I get flamed for this, the law doesn't have emotion or at least it shouldn't, i also mean no ill intent with this but if the officer is competent he will try and get the information I just stated, though that is unlikely that he will go this far to find the truth, and will assume what the truth is even though he knows about what has happened. Edit: May 24 at 1:36 Are you refering to the accident that happend at the intersection of MT Pleasant RD and Pleasant Point LN? Ether way the driver left the scene, reguardless of being intentional or not, they will goto jail if caught for attempted vehicular manslaughter, but if he dies even if its a few weeks later the charge can be uplifted to vehicular manslaughter. It could have been driver inattention and not have anything to do with color. |
