I don't know what to do.......please help me?



On Saturday at 11, some kid I know called me up and ask me to come with him to check out a motorcycle he was interested in buying. The guy that was selling the bike would not let anyone ride it because it was not insured. But the kid still liked it and bought it anyways. The kid had no licence so he wanted me to ride it back to his house(I'm licensed) So we go got a license plate off another bike just to use to get it back to his house. I got the bike up to about 45 and it started to shimmy bad and as I went around a bend it got worse. And I lost it. The seller said it was inspected but it wasn't and said there was nothing wrong with it. but there was!!! I Had to be tranported to the hospital. Ended up with a concussion, road rash, and a crack in my spine. and im going to be out of work for no less than month. What should I do now? other then get better !!!!do I need to pay the kid for the bike? it was 2900....im going to be paying more then that for everthing just for me to get better

NO. You do not owe anything legally or morally. It is not your fault. Tell your "friend" that he must take the seller to small claims court and you will be willing to be a witness. In most states it is illegal for the seller to sell a "lemon" vehicle. One that has problems. He should not have bought a bike before test driving it! And he should have known that if the seller refused test driving it then there was a problem! He should not have bought the bike.
It is not your problem.
You and your friend need to BOTH sue the seller of the bike. Your friend needs payment for the price he paid plus medical costs for himself. YOU need to sue for pain and suffering and medical bills.
So both of you take that man to court ASAP. Do not wait. Tomorrow go to your local small claims court and file paperwork to sue that man.
HE owes the money to you and your friend for selling a lemon. Get a licensed mechanic to write up their opinion of the bike plus the insurance company who insured the motor cycle (if it was insured) to write up a report of the bike too.
If your friend had insurance on the bike you may want to get coverage for your injuries from his insurance company. Sue your friend if you dont get anything from sueing the seller man. Dont think of him as a friend if he is so quick to blame you for the accident and make you out to be the bad guy when YOU were doing HIM a favor!
your friend was lied to by the owner of the bike thats why you crashed
your friend should legally be able to get his money back unless you did something else that was dumb like not get legal ownership transfered

Go shoot up a hospital.
Not a lawyer, but if the guy (seller) told you the bike was in good shape and only that he didn't want anyone to ride it to check it out because he didn't have it insured,,,insurance or not he knew the bike had problems and should be held responsible
I would pay for half the bike and keep it!

The kid took a risk having you ride it for him, he asked you to do it, becuase he could not, you accepted that responsibility!

However you now have hospital bills to pay!

You should pay your own hospital bill, pay for half the bike, and keep the bike!

Or have the have the kid pay for half the bike half your hospital bill and he can keep the bike

The thing here is both of your hold equal resposibility.
