I was involved in a road traffic indedent. What are the concequences?


In late 2007 i was involved in a road traffic incdent, or accident, in which i collided with a motorcyclist. There was no damage to my car, however the motorcyclist fell of his bike and had minor injuries and was discharged from hospital in 30mins.

I recently got a letter requesting me to attend court, and whether to plead guilty for carless driving.

If i am found guilty, what are the potential concequences?

I am 20 years old, a student, i have 0 points on my license, no previous motoring offences or accident, no previous criminal record and i am insured fully comprehensivley.

What are the concequences of being found guilty, and what is the most likley scenario, and what is the worst case scenario?

A few points and money no jail time if thats what your worried about. You did hit him so your liable.

I was the motorcyclist a few years back & after the car driver refused to answer any corespondance I took them to a small claims court.

Justice was done.

Hire an attorney... and you didn't give the story of exactly what happened so nobody here can determine if you were reckless or if the motorcyclist was at fault....

(I wouldn't plead guilty though, let the courts decide instead of throwing yourself under the bus)

The various "careless" offences attract 3 - 9 points plus usually a fine; as you've received a summons it's clearly thought there's enough evidence to prosecute you.

You ought to consult a solicitor, though frankly I'd stand upright and plead guilty, as you plainly know you were from what you said. You'll get the opportunity before they pass sentence to address them, that's your opportunity to apologise for your silly mistake, apologise to the motorcyclist and apologise to the court for taking up their time. They will listen.

(I take it, by the way, that any insurance business has been sorted out)

you must know if it was your fault or not ?? ask your insurance company...but I suspect youl`l stand in court and accept the consequences like a man ...........

Really they can slap a big *** fine on you, take away your license, and tell you, "you can't drive until your 21." That is for most states. I don't know if that's always the rule but most likely. Tell them your side of the story you just might get out of it. But you really need to get as many details as you can.

Considering it sounds like it was not a very serious accident as the motorcyclist only had minor injuries you wouldn't be subject to harsher judgement that would have occured if there had been a death or more serious injury. Seeing how it is your first motoring offence (I assume) it's likely that a judge would pass a rather leaniant sentence. I'd say the most likely option would be that your license was suspended for a short time period, you would have to attend some driver training or something along those lines. I doubt it would resort to any actual jail time. I'd go speak to a lawyer.

At the most you'll get 3-6 points on your licence and up to a 300 pounds fine,don't worry you defo won't go to jail.By the way if its a clean cut case and you are defo to blame do not deny it,the judge will take a very dim view and you will lose your licence.all the best.

One problem for later might be if you are found guilty or just provide more information, that information could be used again later in a civil case. Civil cases with a lower standard of proof needed.

The rider may not be after you, he may just be hoping for an insurance payment for injuries.

Its hard to give you a likely scenario as we are not magistrates judges nor do we have all the facts however i can tell you the worst case scenario if the book was thrown at you would be.

A fine not exceeding level five on the standard scale - "up to 拢5000 i believe"

Obligatory endorsement - licence endorsed three to nine penalty points. "You will get 3-9 points minimum"

Discretionary disqualification. " at the discrestion of the judge if you get banned for a period of time"

Remember the above is worst case senarios and normally would be a combination of a fine and points.

Seek legal advice thought on if its worth going not guilty and fighting the case.
