What to do if you have received a paid item in 2 months?

I paid for a quad bike 8 weeks ago and they said that it wud be here within 2 weeks, 2 weeks later not here I Rang Them Up And They Said It Be Tere Next Week Are Stock Was Late Now Finaly It Came But It Was The Rong One Which Isnt Worth The Money I Paid. Sooo I Rang Them Up Agen Tey Said Ok Tey Pick that one back up and deliver the rite one, 1 week later they said the supplier we got them of has gone Bankrupt, We Will Send A Check 8 Week No Check They Said It Would Reah Here On Monday But Hasent Every Time I Ring Them Now They Say The Manager Isnt Tere. Please People can you give me advice it has now been 9 weeks Thank You So Much For Your Time

If the place is local, go there and demand answers. If you are a minor (under 18) take one of your parents with you.

If not local, ask when the manager will be in and this is a urgent matter. Call multiple times (2-4 times) a day, every day. If they stop answering the phone, then start blocking your number out before calling. Might also be a good idea to have someone else besides you ask for the manager. Go over the managers head if possible...maybe the owner of company.

Small claims is a good avenue if all else fails. But if you can file in small claims will depend on how much you paid for bike. There is a cap as to how much you can go after in small claims, anything larger has to go through civil court instead. The cap is different from area to area...my local cap is $5k.

One bad part of suing them is that even if you win, you have to collect the money from them. Sometimes they will not pay it and you have to take even more legal action to collect.

When you finally get a "manager". Ask them why it is taking so long for your refund. Ask them for a specific date when you can come PICK UP the refund (if local). If they give you the run around, bluff and say you have already contacted your attorney about this matter but are trying to give them a last chance to do what they have to do and that if it isn't done by this date (around a week) you are filing suit and will see them in court. Also let them know you are going after any fees related to getting your money back. Fees like filing costs, lawyer costs...making it cheaper to just refund your money.

I would not accept any more "it will be a few weeks" answers from them. The only legit reason I can see it taking as long as it has is they already gave the money to the supplier and the supplier is not returning the money. You should press heavily as to the reason this delay is happening.

Until the time comes to where a manager or whatnot contacts you, take that time and contact local attorneys. Most attorneys offer a free consultation, use it to your advantage. They can advise you on local law concerning your issue and possibly other avenues to reclaim your money.

Lot of times a law suit will light a fire under someones butt to get things done.

While doing this, control your anger. Walk the line of polite and pissed off. Do not make any threats besides legal action.
