Each state has it's own laws governing the legality of bikes. It is not one standard for the country. The DMV and/or the police dept should be able to answer you since they are familiar with your state's laws.

The Feds have a lot of standards. If I built a pocket bike that met a couple of them (say the standard for threads on bolts and the standard for flammability of upholstery), then I could with a straight face say this bike meets federal standards. That's a long way from asserting that it meets all federal standards for a motor vehicle. Emissions, safety, ....

But as someone else pointed out, it is the states that register motor vehicles so if your state doesn't consider the pocket bike to be road worthy, you can't register it there. NY state has clearly said "no" (though your assertion that the seat is 30" high makes me think there's at least room to argue that the pocket bike you are speaking of is a motor scooter legal for road use, not the pocket bikes (mini-bikes) that people quickly insist are not eligble for road use. You'd probably be smart not to call it a "pocket bike" when you are within earshot of your local DMV.

Does it meet the standards of the STATE, that you are attempting to register it in is an equally important question that needs to be asked.

The VIN needs to be registerable. It has to be the correct VIN for that vehicle. VIN's have nothing to do with Federal Standards.
