Can I still have someone arrested if I find them after the police ULS? |
My car was hit by a hit and run driver. I followed him and got his license plate and saw his face, I've seen him in this area, he is under 18 and possibly driving without a license. I filed a police report, all the police officer said "he is 3 steps ahead of me and they are on him", I filed charges. A month later I got a paper from the police stating they were unable to locate suspect. I've seen him recently on my street, can I still have him arrested or can I make a citizen's arrest or what. I need a POLICE OFFICER's opinion. This is a hit and run suspect the police were unable to locate for me but I found my own suspect, what do I do. I was stopped at a stop sign and he backed into me, there are kids that ride there bikes on my street now, I don't want any of them killed by this reckless guy. Just call the police department and have them send out an officer, and then show him the vehicle. Its that simple. I have actually found hit and run vehicles months after the actual accident. People will call and say that they found the vehicle, I then must make contact with the owner and find out who could have been driving............... im not a police officer but i say if you know where this guy is and who he is then yes call the police tell them the story say you have proof and have them check into it he wont get arrested but he will be paying heavy fines but make sure you have everything to make your story real or you can get sewed Making a citizen's arrest is a tricky and dangerous thing. For instance, have you thought about what you will do if he resists your arrest? What if he resists with deadly force? What will you do once you have him? You would be obliged to take him forthwith before the nearest magistrate. Any idea how you will do that? Next time you see him, try to find out his name and where he lives. Give that information to the cops and if they don't do anything about it, call the local district attorney to ask if they can do anything to get it moving. By the way, you can start a civil lawsuit for damages without the assistance of the cops, although no one gets arrested in a civil action. You say you filed charges on him, did the police get a warrant for his arrest? Did the paper you recieved from the police state that they were no longer going to pursue the charges? If not, when you see the guy driving, call the police and ask them to respond. Personally, I wouldn't try a citizen's arrest because the way people think out there today, you'd get sued and the perp would win, especially if he is injured in any way. Keep your eye out for him and when you see him, call the police on your cell phone and let them know where he is (try not to let him see you doing this). This isn't a high priority so be aware they may not come running like they would if it were a kidnapping, robbery or burglary in progress. Citizen's arrest for traffic accident will put you in jail most likely. |
