Can I be held liable if neighborhood kids get hurt on my property? |
Our house is where all the kids congregrate, especially in the summer since we have the biggest front yard on the block. They like to use my kids skates, bikes and skateboards. If one of the kids gets hurt while in my yard, can I be held liable for paying their medical bills. For example, they fall off a skateboard. Is there any way to protect ourselves other than just not letting anyone come over? Yes and no. If someone gets hurt on your property, you can be liable, but they would have to show that you were someone responsible. Did you fail to exercise reasonable care? Did you knowingly leave hazardous conditions in the yard? If the injury resulted from your reasonable failure to act to prevent the injury then you could be liable. You can only be sued if there is negligence on your part. If they are just out playing and there are no hazards on your part they cannot sue you. If a kid gets hurt as the direct result of your negligence, you are liable. In my opinion, you are taking a risk if you allow kids, other than your own, to use skates, bikes, and skateboards that belong to your kids. Perhaps you could meet with the Parents of the visiting Kids and get written releases from them. Have the release forms prepared by your attorney. YES!!!!! Trust me, I know from experience! If a child gets hurt ON YOUR PROPERTY, you are responsible for that child's medical care, and any other care they may need! This sounds harsh, but what you have to do , is have their parents sign a paper stating that they allow their child on your property, and they assume all responsibility if the child is to get hurt in any way. This way you are covered. You are liable if someone is injured through your negligence, on your property or anywhere else. If the are injured in a pure accident, and there is no negligence, then you are not liable. One can be negligent in failing to maintain property. For instance, if you had a poorly built skate-board ramp that collapsed, that could be negligence. Regardless you need liability Insurance, with your household insurance..I also carry a separate "liability" package, that goes with me when I leave home. If you put down a sign saying something like "Play at your own risk". Then you can not be held liable for paying their medical bills, because they have had a warning. You will be liable. Due diligence. Make the parents watch them when they are over. |

Boy, this is a hard one to answer. I think the best thing you can do is to take it back to where you bought it and have them correct the problem.....or take it to a bike shop and pay them a few b... If he's small or average for his age he will need a 12" bike. If on the larger side maybe a 16". Both normally come with training wheels. Best thing is to head over to Wal Mart, Targ...
