Can I sell my husband's dirt bike? |
My husband and I are seperated and have been for 6 months. I am having a hard time making ends meet as he has not helped me out financially since he left. He still has a lot of his things here at my house...not our house as it is in my name only. He has a dirt bike here that I would like to sell to help pay my daughter's medical bills but I am unsure if I can legally do so. We live in Iowa and the bike is not street legal so I don't think it is liscensed or anything. I am not asking to be vengeful, I'm just trying to provide for my kids. Wow!!! I am sorry to learn of your situation. It always saddens me when I learn of men not fulfilling their obligations to their families. Although the bike is not street legal, you may want to find out if it has a title or not. If it doesn't have a title then you should be able to sell it with no problem. No, you can not legally sell his dirtbike without his permission. You can't sign his name on the title - that would be fraud. He has a right to keep his things there, regardless if you are separated or not unless he is court ordered otherwise. It still is, technically, his home too, until you are legally divorced. well let's look at it this way, is there any paperwork to this bike? something that would prove that it isn't legally yours to sell? i'm assuming that there isn't. now consider the fact that this bike is on YOUR property, and so long as you have given him plenty of time and opportunity to fetch his things, then you can do what you will with it. well the thing is, even it a drirt bike, it still got a tittle, so,, first you need to see who name on it, now if he say bought it 2th hand an no paper was giveing to him saying he bought it, then it fair game,,, i think you would need to talk to the law on this, then go from their Let him know your going to sell it first so he doesn't freak out about it. Now say you find someone that wants to buy it and doesn't necessarily have to have the title in their name then by all means sell it and tell him it got stolen if you know that he want go to the police and file a report. ( You wouldn't want the police to find it and take it away from whomever you sold it to). Now if it was me then I might have a yard sale and sale off some of the stuff he has left over there, But if push comes to shove then you need to have backup ( proof ) that the money went to medical bills or lights or insurance or house payment. Call DMV. If it is registered & has a tag, they can tell you if his name is on the title. If his name is on the title, you can't do a thing. If you sell it and he comes looking for it, you're gonna have to give the money to him. He can sue you for it & you might end up having to sell your house to pay him back. |
