and an adult is riding it. ohhh and i'm in southern California! Contact the local police dept or DMV It all depends on the city and state. The city may have a helmet ordinance for a scooter or the state could have a law requiring them also.
Contact the local police dept or DMV and they can varify. Nope, it's got no motor. Check with the local police dept. Here it is required. Different from city to city depending on laws. Its not likely they would mess with you though. But still good to check. I would suggest that you check with your local DMV and get a copy of the regulations in writing. Look, it doesn't have a motor, but even in some states bicyclist has to wear a Helmet.
If you should take a spill, you would not be falling as if you tripped over your foot. It can still be dangersous. If a woman can trip off of a curb and have a miscarriage, someone can plant their foot wrong and break an ankle just crossing the street, there is a chance for severe damage. A bicycle helment should surfice.
Freak accidents happen all the time. Do yourself a favor and try to protect yourself as much as possible.

Good Luck $35 or so for a basic bicycle helmet means that you're less likely to get a severe head injury... which can lead to such wonderful things as a coma, severe vegetative state, or even the more likely... just being stunned for a moment so you can't easily drag yourself out of the way of the approaching delivery truck.
If what's in your head is worth more than $35 to you, buy the cheap insurance that a helmet provides. Wear it. Every time.
If you're not providing for your family, and you're confident they can get along without you, and you don't mind setting a bad example for children who don't know any better, please don't ride in my neighborhood.
Will a cop pull you over? That's the least of your worries. Brakes on those things fail (They're not all that great to begin with), which means you can "accidentally" be heading out into traffic at a pretty good speed, instead of stopping at the intersection. Personally, I'm less concerned with getting a fine than I am with being unable to walk.
The real question to ask yourself is "why don't I want to wear a helmet?" Are you concerned that it will make you look uncool? (You're an adult riding a kick-scooter. People won't be looking at the HELMET and snickering. Trust me.) Are you concerned about the cost of the helmet? ($35 should get you a basic helmet; that's less than a day's wages at the current federal minimum... compare that to hundreds in medical bills) Are you concerned about how much time it takes to put on? (1 second... maybe a whole minute, the first time, when you're adjusting pads and straps) Are you concerned about where you're going to store it? (Where are you putting the scooter? The helmet will likely fit in a standard locker...)
I wear a helmet on my bicycle, I wear a helmet on my motorbike, when I'm working and people can drop stuff on my head, I wear a hardhat... Just the short & sweet of it. If a legal requirement applies then yes. If COMMON SENSE applies it's yes again. Remember, it's not who your going to hit, but who is going to hit you.
