Street legality of a moped?

I was wondering the street legality of the moped listed on the following website: http://cgi.ebay.com/X-TREME-Gas-Scooter-...
I live in New York and I have read that I would probably need insurance and to register it. Does anyone know what I would need to do to make this moped legal on the street so I can take it to my classes?

That isn't a moped. It's a gas scooter.

Riders must obtain a motorcycle driver's license, which in New York State requires that you pass a written test and either pass a road test or complete a rider's course approved by the Department of Motor Vehicles. (Information at nydmv.state.ny.us.)

I have an older model of this and if it's under 50 cc, which yours is conveniently 49 cc's, than it doesn't need to be registered but you cannot drive it on the road. Check with your local police and see what they say because they'd be the only ones who'd give you grief about it. Good luck and have fun!

It must be insured and registered. Further more you must have headlights, taillights and brake lights. Of course a license plate and an inspection.

Anything that is 50cc's or less doesn't need to be registered.
