Yes you would be liable. First of all you should have liability insurance on your property (you pretty much have to, even on your own house). Second you could put up signs saying "use track at your own risk" and "No Trespassing". Finally you could require him to sign a disclaimer releasing you of all liability. Different states will vary, but most will be pretty much the same. Everything that goober_head said plus get an umbrella insurance policy. They don't cost much and cover stuff like that when your regular insurance policy hits its limits Society is in a sorry state if we have to insure our own property incase someone hurts themselves when wrongfully using it.
