Ok say you are riding dirt bikes on your own private property, can the police still bust you ? Are your bikes loud enough to be considered disturbing the peace? Just because the road itself belongs to you it doesn't mean sound suddenly stopped carrying over to your neighbors. Other than that I'd think no. Still, if you really were arrested under those circumstances the first thing you need is to find out what you were charged with, then take that to an attorney. Many will offer a low cost or even free consultation to tell you if it was justified. Just don't plead guilty or pay the fine before your court date until you find out. (Paying the fine is like pleading guilty). If the cops were in the right, suck it up and find out how to ride them without it happening again. If they weren't, well that's why we everyday people need attorneys. No they can not has long has they don,t go on the main road i dont see what they could do cause ur own ur own land!!!!! It all depends on what they busted you for. Some things yes, some things no. I deal with private property crime for a living, so those people telling you that "as long as you are on your own property it's ok" are very wrong. If it is private property then no they cannot. They have no authority on your property.... There must be a couple of factors present to make a legal arrest. First, there must be prpbable cause to believe that a crime has been committed and the person to be arrested is the guilty party. Second, generally only felonies involve arrest and transport to the local lockup. If all you are doing is riding dirt bikes, that should not qualify. Even if you were making a racket fit to wake Lazarus himself, disturbing the peace is generally treated as a misdemeanor, which means that the suspect is cited and released at the scene. Like if it is after 11:00 P.M. you are making to much noise with the bike yes. It just all depends on what you are doing. In most cases he has no jurist diction on your property. Unless you are breaking the law. |
