I got a ticket for trespassing what can i do? |
me and my friend were in the woods on a path behind a school and the cops came and accused us of setting off fireworks they searched everywhere didnt find anything and said we hide them and we are lying to them. so they gave us a 92 doller tresspassing ticket when there was someone else in clear site riding a dirt bike and another couple in the woods as well also a husband and wife walking there dog. what are we supposed to do? I guess the big question is: Where you trespassing or not? If you were then the officers nailed you righteously and you should pay up. Sure they probably did that because they thought you did something else wrong and that was the only thing they could catch you at but so what? I noticed you didn't deny that you were guilty of the fireworks issue! If you are innocent then get an attorney or research the trespass laws yourself. I would suggest strongly to you that judges have pretty good BS detectors and you might just find yourself better off bucking up and paying. Edit: I noticed the guy above me stating to use the fact that others were trespassing as evidence. This is a non-issue. They "might" have had permission. And just because someone else didn't get caught doesn't change the facts. You can claim selective enforcement but since the officers were probably responding to a complaint that angle would be a waste of time. Source(s): 12 years law enforcement Pay up. Get a blood sucking attorney. You're going to need one if you want to fight it. The cops had no evidence, so they shafted you. If you have evidence of the other people present that day, present it in court. It would be easier to pay the ticket and forget about it, really. Pay your fine. tell the judge..........or just pay the ticket. go to court and dispute the ticket with the judge. Pledge innocent when they ask you how you want to plea. |
