Is it illegal to listen to an MP3 player while riding your bike? |
i want to startg riding my bike around town instead of the car, but at the same time i'll want to listen to music. so i dont link its illegal to ride a bike and listen to and MP3, but i could be wrong...am i? (btw i live in cali incaseits just a state law...) It's not illegal to listen to your MP3 player while biking, it is however illegal to have both headphones in your ears while biking on public streets with traffic. Someone asked almost this exact question a couple weeks ago, and I'm just quoting my response to that question (which is a direct excerpt of the specific California vehicle code): Wearing of Headsets or Earplugs 27400. A person operating a motor vehicle or bicycle may not wear a headset covering, or earplugs in, both ears. This prohibition does not apply to any of the following: (a) A person operating authorized emergency vehicles, as defined in Section 165. (b) A person engaged in the operation of either special construction equipment or equipment for use in the maintenance of any highway. (c) A person engaged in the operation of refuse collection equipment who is wearing a safety headset or safety earplugs. (d) A person wearing personal hearing protectors in the form of earplugs or molds that are specifically designed to attenuate injurious noise levels. The plugs or molds shall be designed in a manner so as to not inhibit the wearer's ability to hear a siren or horn from an emergency vehicle or a horn from another motor vehicle. Im a large majority of states it is legal to use personal music players while bike riding .... however, you will have to contacy your local or state police precinct to know the truth i dont think its illegal if its not overy loud, if you can clap your hands and hear it you should be fine. in california it is illegal. you can probably get away with only one ear bud in while riding. Actually the California vehicle code refers to the use of "over the ear" earphones, and ear "plugs". The use of "ear-bud" type earphones might be considered a "plug". However, if you were to wear an earphone that only partially covers the ear, you might be within that gray area of the law. I enjoy listening to my iPod while riding, but turn it off when I am on a road without a bike lane, or in high traffic areas. I use a clip on type earphone that loops over the ear and allows me to hear environmental sounds, such as cars and people. The great thing about California is the abundant bike lanes and trails. I only wish more states did as much to keep bikers safe and prevent the ugly biker/driver confrontations. |
