Is a friend responsible for damages on a bike he borrowed from me?


my friend asked to use my bike in a race and he wreckedit badly.about 1300 dollars wort ..is he responsible for damages

When a person "borrows" something it is implied that the item will be returned in the exact same condition that it left in. There may some wear and tear but no damage. The person borrowing it is responsible for any and all damages. However were you aware of the reason he borrowed the bike? If you were aware of the race then you may be held responsible as you were aware of the risk involved.

He is as long as he is licensed to drive a motorcycle. If he is not, then the law is on his side because you should not have let him drive it. Like if you let an unlicensed driver drive your car and they got into an accident you would be out of luck and would also have to pay for whatever damage they did to someone else's property. So if he has a license then yes, if not, then you should still try to make an arrangement to have him pay you but you wouldn't be able to sue him or anything.

I say he fully responsible, and if he is a true friend he will take care of it, also not just being a friend, but a real man and stepping up for what he know he done, yes it was a accident but when he asked to borrow that meant full responsibility for something that was not his.

I'm not sure...did you guys have an agreement beforehand? Either verbally or written that if he damaged your bike he would pay for it? You can try to take it to small claims court but I don't think he is liable. A good friend would offer.

Yes he is. But what type of race are you talking about? If you are talking an illegal race then you are both pretty much screwed.
