A motorcycle title in under my name, but someone else has it in a storage unit, can i report it stolen?



The bike is mine, and the person won't let me have it. He has it locked up in a storage unit. Can i report it stolen? and will the police break in and get it for me?

Not really. How did this person get it in their posession in the first place? If they took it without your permission, then yes, if you asked them to store it or hold it for you and now they will not give it back, then no thats not a correct charge. Have your title in hand, call the police and ask to have an officer stop by due to a property dispute. When the officer arrives explain that you own this motocycle and its being held by So and So and they will not let you have your property, and ask if they would go there with you and help you retrieve the property.
IF it was stolen! Yes, other wise you'd get into trouble.
I would break in and get it (if there is no legal reason why he has it!)

You're leaving out important information. Why is it the storage unit, and how did it get there. Why won't the person give it back ?. Do you possibly owe money for the storage?. Either way, no, you can't report it stolen, because it isn't. It is illegal though to hold a persons property for ransom. If this is the case, then bring your title with you, and call the Police from a location close to the storage area. If the owner is there, the Police should be able to help you recover the motor cycle, but they can not forcibly enter. The storage owner would have a right to file civil action against you, but not with the Police. Again, I'm guessing, but I'll bet I'm pretty close.

That's a very tricky question and there are a lot of variables to consider to give a really great answer. Here's my shot at it:
1. The police WILL NOT break into the storage unit and remove the bike for you without a court order.
2. Since this is not an emergency, contact or go by the police department and file a report and, if possible, press charges. Keep in mind that they may advise you that this is a civil matter (not criminal) and not get involved. If they tell you this, insist on a report and obtain a case number so you can obtain the report for any small-claims courts action. Consult with an attorney to make sure you have all your bases covered for the suit. What you want is the monetary value of the bike or the bike itself.
3. If they do allow you to file charges, keep after them to follow up.
4. It's up to you but you may want to inform the person that you've filed charges and are willing to drop them if he/she returns the bike. This may help or hurt so I'll leave that up to you.

There are some other details that you haven't mentioned so I won't assume anything other than what I've already stated.
