Motorobike ownership?



I bought a 125cc bike for myself to use, and my fiance to learn on, its regestered in her name, as i have a few other vehicles, she text me the other night to tell me it was over, and has not only told me she is keeping my bike, but has padlocked it to her garage floor. i have proof of purchase, so i know the bike is legally mine, despite what i read on other postings(iv seen lawyer so i know where i stand) but the padlock thing is a new development, can i damage or take bike with padlock? im now worried i can get arrested for stealing, or damaging goods over this dam lock and chain? she is away, and i have access to my old garage, so im not breaking and entering, its not fair that she dumps me out of the blue, AND keeps my new bike

i haven't heard of many people registering there dirt bikes? you must be a pretty honest guy, so don't go breaking in. show her that you don't want to fight anymore when you talk to her. then ask nicely for your dirt bike. if you paid for it, she will give it up. then twist that throttle wide open until you find a cooler chick.
Go get your bike. If she causes you trouble, knock her on her asss.
Is the garage at a rental that you paid rent for, or is it her home, that she is paying for (or paying rent for exclusively)?

If you're not on the rental agreement, or can't show that you've paid to live at her home, then you don't have a legal right to be on the premises without her permission (with or without a key).

Since you've already spoken to a laywer about who owns the bike, then I'd go back and ask about how to get your property back.

I believe they'll tell you to take your gf to small claims court.

You're going to have to do something like this legally anyway, in order to get the title taken out of her name, and put in yours.

If you do have some stake in ownership (or rental) of the property, you can legally go and get what is yours - but you're right about harming something she owns (the lock) in the process. This would be a small problem though.

The larger problem would be getting the bike titled in your name again. You won't be able to take the original title (with her name on it) to the DMV and simply ask that ownership is switched to you. The only way they'll do this is if she signs over a title transfer.

If you get the bike back, but don't find a way to get it titled in your name, then you could set youself up for other problems (namely, she could report the bike stolen, and give you a major hassle to prove it's yours).
