I was in a car accident and it was not my fault. Can I be sued?



I was diving at night and a girl on a bike with no light ran out in front of me. I swerved to avoid hitting her. But my side mirror hit her still. The officer said the acciedent was not my fault and was not issued a citation. What should I do scared inurance will raise rate I can't afford.

From what you have said, you cannot be sued. You were not found to be at fault and were not issued a citation.

With regards to your insurance rates, you will have to decide if you want or need to bring your insurance company in on this matter. If the girl (or her family) attempt to hold you liable for expenses, then my suggestion to you is to consider bringing your insurance company in on this. Not because your insurance has to cover it, but because they can best protect you in this situation. While they may raise your rates, they can protect you from other, greater costs.

If the family does not make attempt to hold you responsible for expenses, then there is no need to bring you insurance company in on the matter, and they will have no reason to raise your rates.

If the girl (or her family) tries to sue you for more than medical expenses, fore-go your insurance company, and hire a lawyer. Again, they should have no case, as you were not at fault. In fact, although you did not mention it, the girl should have had a citation for failing to follow your municipality's bike laws, among other things. Since it does not involve your insurance company, again, your rates should not go up.
parental neglect is what i would be thinking of. why is a child allowed to ride her bike in such conditions....how is the girl & good luck
Unless a claim is filed against you the insurance co. will have no knowledge that the incident happened.
If a report was filed and the girl was injured she may seek damages...you were not issued a citation....your insurance co. will refuse payment. She will have to prove that you were at fault.

your pretty safe at this point. the officer was right. in most states at night its the law to have lights on your bike to let drivers know your there. she should have been watching and not flying out in front of cars. your fine and shes lucky she wasn't hurt worse.
