Moped Crash.? |
This morning, I was riding a moped. There is currently some flats being built so some temporary traffic lights have been set up. The light turned red so I pulled the brakes. I wasn鈥檛 going over the limit and I didn鈥檛 brake to tightly. However, due to the stones and other debris from the building works, I skidded out of control and came off my bike. It caused quite a bit of cosmetic damage and the wheel and steering bar will need to be realigned. I guess it will need to be checked for other damage. There were no signs warning over loose debris (which I think exist). I am entitled to money from the building company to cover costs? Am I entitled to any extra money for the fact I crashed and this obviously wasn鈥檛 fun! What is the best course of action to take? They are a big company. Any help would be much appreciated. Thanks! to make any claim like this you will need photos. get back there and take photos to start with before it gets cleaned up dnt kno i think u can Call Your Lawyer. first contact the company and inform them of the accident. They may offer you adequate compensation. If not go to see a solicitor. But before you do either get photos of the debris on the road at the accident scene You should have braked when the amber light came on--amber means stop...its in the Highway Code. First things first, get back down there and take lots of photos of the debris on the road and the damage caused to your bike. Try and make sure there is a digital time stamp on the pictures. Then get an estimation of the repair costs to your bike and any clothing that was damaged. I would suggest that in the first instance you write a letter to the director of the building company, enclosing copies of the receipts for the damage and ask for your costs to be covered by the company, dont rant and rave in the letter, but ask for a response within 28 days and send the letter recorded delivery. If that fails I would suggest first port of call be the citizens advice bureau and see what the reccomend, I dont think at this stage a "no win - no fee" solicitor will take the case, even though you do have one, because its not really their remit. You should also check with your insurance company and see if they have a legal cover on yoyur poicy that would take your case. Good luck with this, as a fellow motorcyclist its time that the building contractors who continually leave rubbish on the roads were held to account. When operating a motor vehicle you are responsible for its control and safe handling. You were obviously traveling too fast for the conditions or you would not have crashed. Had you been driving slower when you saw the gravel, you never would have crashed. |
