Debt problems--please help--advice needed?


Ok.My ex boyfriend(who i have a child with),got a motorbike out on hp when he was 17.His auntie became guarantor because he wasnt 18...It was done through Blackhorse.He got the bike in 2000 and paid 拢100 a month for 18 months.He has a insurance document saying the bike was worth 拢2000.After 18 months of paying,he stopped paying and had letters from blackhorse demanding payment.Anyway,The debt people said if he gives the motorbike back then they would wipe some of the debt off-so one morning a bloke came to my house and i signed a form and gave him the bike keys+he took it away.
The bike was worth 拢2000 but coz of hp he had to pay 拢3600!Blackhorse sold the debt on.Now solicitors want 拢3800 even though he paid 拢1800 and gave the bike back?His auntie is getting threats coz she owns her own house and she is so upset as she thinks they'll take her to court..can anyone advise me on what to do?Also the solicitors say my ex didnt give the Bike back(but i have a letter sayin they took it) xx

right then.........insurance wise is diddly squat,i could insure a 拢500.00 car for 拢1,000.000 if i wanted to so thats out of the window for a kick off.now the aunty has gave him good will and signed as guarantor,that legally means if he doesent pay the debt owing,it will fall on her,no question about it. get your boyfriend to get in touch and arrange payment with them,otherwise they will pursue aunty?

I'm sorry for your troubles,citizens advice would be a good start ,but because his auntie was guarantor she is liable for any debts plus any more fees that go on top so she needs to go to get advice quickly or the debt is going to rise even more ,god luck

Sounds like one for the CAB. Give them a ring or go and see them. They should be able to advise you on how to proceed. Make sure you keep every letter and a record of every phone call too.

If it was HP then the loan was secured on the bike. The aunty was probably the official party to the contract rather than a guarantor. If they repossess the bike thats it, debt gone. Its possible that the form you signed was an agreement to voluntarily end the HP agreement, in which case you need to have paid, in total, half of what was originally owed. But you couldn't make that agreement if the HP was in someone else's name.

If it wasn't a hire purchase, but was a loan agreement of some sort then it is a different story. Everytime a new debt collector or solicitor gets involved they add their own fees to the debt, and the loan could have been on a very high interest rate, which is why the amount owing keeps growing. If this was a secured loan they could take away property, or even put a claim on your house (or the aunty's) to recover the debt. Your best bet is to pay up ASAP. If it was an unsecured loan they cannot do anything to force repayment. You may have it hanging over you, but they cannot turn up with the bailiffs.

You need to see your own solicitor, or citizen's advice, to get someone to look at all the documentation and work out what position you are actually in.

If the solicitors say the bike wasn't returned, then either there has been a cock-up or someone has stolen the bike. If its a cock-up your letter is all the proof you need to fix the situation (keep the original, send a copy!). Otherwise report the theft to the police. At least you can then claim on the insurance.
