While riding my bike I was hit by a driver who hadn't a license or insurance. Am I able to get compensation?


I was told to file a crash report with the DMV. Will that really lead to anything or is it just something they put on file?

You prob. should have called the police on the spot once you found out the person was unlicensed....but that is water under the bridge...

You must deal with the other driver. (Bike is assumed to be a MOTORcycle not a BIcycle - you didnt say)

1) File the report with the dmv so you have a paper trail of the accident. In California you are required to do that if the damage is over a certain amount or if there was an injury. Most states have similiar laws Failure to do this may effect YOUR license)

2) Do you have uninsured motorist coverage? If so turn it over to YOUR insurance company - thats what you pay them for and it won't affect your premium.

3) No coverage? Summarize all your costs and expenses and send the bill to the other driver as a claim giving him a reasonable amount of time to contact you and settle up. Send it registered mail.

4) No response or a not acceptible one? Find out what your small claims limits are in your state. If you fit into that category, prepare your documents and your accident report, take photos, get statements, and take him / her to small claims court. It will cost you about $100 or so to file and serve the papers. but you will get that back if you win.

yes it will fall back on the people who hit you and they will have to pay the damages and medical bills(if any) I definatly would file the report

You'll have to get a lawyer but it's worth it.

If you have "uninsured motorist coverage" and/or if anybody else in your "household" has uninsured motorist coverage, you can pursue a claim against that portion of the policy.

Whether or not you are entitled for Bodily Injury compensation(pain and suffering) depends on whether or not you meet your state's threshold requirements.

Depending on what state this happened in you would also be covered under the Personal Injury Protection part of the policy. PIP covers your medicals and lost wages.

If payment is made, your insurance company will attempt to recover the money paid out directly from the uninsured motorist.
