I need a cycling lawer?

I got hit by a car, and the person did not stop. I got back on my bike and cought him. Police said nothing we can do w/out a witness. I have to deal with his auto insurance. Not an easy thing to do without knowing any thing about the law.

My bike frame is bent and un-repairable $2,000 dollar bike

Either you are leaving something out or the police officer was a fool. Under these facts, the driver was guilty of hit and run. The officer could not arrest for that, since he did not see it, but YOU could. There is no requirement that anybody other than you know that the offense took place.

I would suggest four things.

1) Notify your insurance company, and his.

2) Make a report to the police department, including the name of the police officer who refused to take action on a hit and run.

3) Make a report to the local prosecutor, which I believe would be the Orange County District Attorney in Anaheim. (A criminal complaint can be filed whether or not the police make an arrest.)

4) Do a Google search for "southern california bicycle accident attorney" to find an attorney who specializes in this type of case (note, this will NOT find me--I'm not looking for business). I would not recommend settling with any insurance company without at least speaking to a lawyer.

You may find that witness, hang out a couple times where the accident occured, bring a sign with 4 inch letters asking for eyewitness, you may, write down there name and phone # and a brief description of what they saw, have them sign, you are now ready for small claims court and if the wit will cooperate you can have driver cited for leaving seen of accident, which is more evidence for your case.

You should hire a personal injury attorney. The cop is wrong. You don't need a witness, you are the witness.
