Hauling a motorcycle in a truck...?

if your hauling a bike in the bed of your truck and someone hits you, damaging the bike, would the truck's insurance cover the damage to the bike while transporting?

even if there is no insurance on the bike?

thanks

so lets just say its a $35,000 hot rod bike and it is completely destroyed and both persons involved only have state min. liability... do you think i would be able to get enough to actually replace the bike?

Anything in the back of the truck is considered to be cargo, even if it was a motorcycle. If the other driver is found at fault, then HIS insurance should pay for all repairs.

If you have collision/comprehensive (full coverage) insurance, then your policy may pay something on damage to cargo, but if you file a claim, you will have to pay the deductible before the insurance kicks in, and your rates would be subject to review, so you may end up paying more for your truck insurance. It's your decision, but you may be better off just paying for the repairs out of your own pocket.

If you are not hauling the bike for a fee, if you do not own the bike and if you are negligent, then yes the damage to the bike should be covered under the Property Damage coverage of the policy. The amount paid under the Property Damage depends on the jurisdiction where the loss occurred, and the percent of liability on each party.

However, if the bike is yours, then most auto policies, if not all, will not cover the bike for this loss. Insurance policies do not cover you for the damage to your property. Cargo coverage is usually restricted to business policies. You would either have to have collision on the bike and/or there may be an endorsement that would cover the bike. If you were not at fault, the at fault driver's insurance company would pay for the damage to the bike. If the damage exceeded the minimal policy limits, you are on your own. If the bike is worth more than $35k, I would certainly recommend that you consider buying full coverage. It will be costly, but perhaps worth it in the long run.

The truck hauling the bike - their insurance probably would not cover the damage to the bike. Unless the bike was on a trailer. There are usually conditions in a policy regarding towing and hauling of any sort that is not covered.

The person who hit the truck- Their insurance would be liable for all damages(the truck and the bike) If they only have state minimum coverage, and the dmgs exceed that. Then the settlements would be pro-rated.

Regardless if there is insurance on the bike or not- but that is foolish not to insure a bike of that cost
