My girlfriend baught me a motorcycle.she paid by check. title and registration is in my name. can she take it?


Okay. the title,registration,insurance,.....everyt... is in my name. her name is not on one thing what so ever. BUT.... she paid for it with a personal check and she claims since she can just show that she baught the bike with her check and then she can legally take the bike back from me.but , like i said ,everything is in my name. theres no leins on title either. the only thing in her name is the check she wrote out for the bike.

No, she cannot take it. You have sole legal title, and that's all the law cares about.

No, she cannot take it. If the title and registration are in your name with no liens, then it's yours. I'm willing to bet you both are fairly young, right? I did a similar thing for a boyfriend when I was young, and I sure wish I hadn't. I just had to learn that lesson the hard way. Like another answerer said, you should've just bought that motorcycle yourself. Head games are bad enough, but it sounds like you two are playing head games with a motorcycle in the custody battle. :(

It is in your name so she cannot do anything about that. The court does not know weather you paid her with cash and she paid with a check. It was a gift and that is that.

as long as she didnt put loan for so and so on the check.then the bike is yours. you might want to write her something by e-mail or text or something thanking her for your GIFT !! and make sure you save her reply ..that way along the way she cant come back with it ..cause more than likely she will say oh youre welcome baby . or something like that ..by her telling you no problem ..or youre welcome .. any courts or anything like that will see it was a gift.. good luck

Two - the insurance is in you name-

And three- if she does take it- you can report it stolen.

Like I said before. If it was not a straight out gift, if you two had some kind of agreement, then it isn't your bike until you fulfill that agreement.

The question is. If you say it was a straight out gift. And she sez it was a loan or some other kind of contract, and there is nothing in writing and no witnesses, who is the judge going to side with?

End the conflict by either paying her in full for the bike or return the bike to her promptly. There's the issue of fair play and dealing in good faith. Apparently, you are seeking a legal way out of being fair with your girlfriend. How can you sleep well at night knowing that you somehow cheated another person out of her hard earned savings. Remember the old saying, "integrity counts." So, where's your "integrity?"
