Car accidents, no insurance, suing?

My fiance was recently in an accident (he was riding his motorcycle). A small car turned left in front of him, he was unable to stop and slid the bike into the car. His bike is totaled, the girl who hit him was uninsured and the car she was driving was not in her name (the guy who sold it to her left his tags and the car is still under his name.)

My fiance does have uninsured motorists coverage, but since the bike is totaled he won't get very much. He just recently got a lawyer but now is unsure if that will help him get any money at all. Because whatever he gets from the insurance that lawyer will get 1/3 of it. Is there a way he can sue the girl who hit him? Or something like that? I just feel terrible that he is going through all this while the girl is getting away with nothing. She's a college student, so it's not like she has any money or whatever, but its still not fair that he won't get much for this accident. Any ideas? If you have any more questions please contact me

I also forgot to add that the accident occurred in Ohio. My fiance is from MD, the girl lives in OH right now for school but has an IL license, and the owner lives in MN

I don't know if that would affect anything or not...

You still have a suit against the seller of the vehicle; the vehicle was still under his name.

I recommend informing the attorney of this fact, and the attorney should pursue investigating the seller's auto insurance information. You should be able to find out the seller's telephone number and address, and inform him he will be sued directly, if he does not disclose the information.

As you surmised, if the girl is a college student, you can still sue her as well, but you may not get any money because she may not have any assets.

Good luck!

Contact the OH Police Dept and get the details of the accident. If the driver of the car was "At Fault", then you`re fiance will get his bike replaced, plus any medical expences that were incurred. You have no case against the seller. He has a Bill of Sale for the car, but if he dosen`t, he can just say she stole it. It was HER car and HER fault, so it`s HER ***.
Either SHE, or her INSURANCE, or her ESTATE, has to cough up the coin. Your lawyer should know that.

I think the strategy is to name everybody in the suit, so one can not shift blame to another. The girl, her parents if she is a minor, the boy, ditto his parents, and a few john does to cover the bases. Somebody there is liable, so you just name them all. If they have no money, get a judgment and lien their future earnings.
