Please Advise Me... Re: Traffic Accident?



I was involved in an accident a few months ago. I was found not at fault the other party she on a bicycle and was found at fault. She was in violation of riding on the sidewalk and on the wrong side of the road. I was pulling out of a parking lot and there was a blind spot (the bicyclist even said to the police) and it is in the report. I find out now she has an attorney and my insurance copany is covering 50% of the blame!!! What can I do to fight back??? Can I take her to small claims and file a case on her. If so, what can I claim ? thanks!! any help would be good!

You may not have recourse. The "victim" has apparently threatened to sue and your insurance company is paying to avoid the potential of legal expense.
No clue but people on bikes act like they own the road.
Although you could hire an attorney, all you could get would be the 50% back. It's NOT worth your time. The $$$ spent in litigation would be WAY more than the amount paid, and I guarantee that this is why your insurance company settled.

you should get an attorney and fight back to keep it all her fault then you can take her to court for the cost of your attorney
