Who is at fault here? |
man on bike is going fast on a residentioal road and a car is turning to go out of his driveway and accidently hits him hard with his bumper he doesnt have a insurance and the biker doesnt have a licence to drive a bike does each other fix their own car or what do you think they should of done any good suggestions are taken well Both better work out their problems privately. Both are in the wrong. and both could face the penalties of non compliance. Are we talking bicycle or motorcycle? Assuming it is a bicycle, the car is at fault. Additionally, in most states in the US, the driver of the car could be faulted for driving without insurance. Both would get a ticket. The biker no license and the Car failure to yield a right of way and no insurance. Most times if it involves a car and bike. Guy on bike is going to be hurt. If not both parties may choose to not call cops. One he has no License and other no insurance. The man on the bike may be determined to be at fault if he doesn't have a motorcycle endorsement, however the person pulling out of the driveway is most likely at fault for improper lookout. Driver of car has no insurance, man on bike has no license. Hmmm...what a coincedence. legally it was the person who was driving the car because they was pulling into the road and should've seen the bike, but the guy on the bike can get a ticket for not having insurance and another ticket for speeding. r u talking about an bicycle. you dont need a bicycle. 2nd of all the car is at fault, pedestrian, and bikers always have the righter way. if your in a car you are supposed to look at all times. if it was a motorcycle the both of yall going to jail becuz u have no INSURANCE......DUHHHHHH Usually, the car would be at fault because he must make sure the road is clear before leaving his driveway. its kind of like turning left on a green car when you need to know it is completely safe and there are no pedestrians, or in this case bikers. if this was to go to the law/insurance people, the driver of the car would have to pay for both, even if the biker was speeding. you cannot prove a biker was speeding without a valid radar, etc. so its an unfortunate case for the driver. hope, if you were part of it, that everything goes well and favors you. |
