Usually you don't need a license to drive a bike and also the person in a MOTOR vehicle is usually held responsible while moving. Really, they're both at fault, but the driver will probably be held responsible for reckless driving, not to mention driving without insurance. When you say bike, are you referring to a bicycle or motorcycle? That makes a difference. Biker was on the road first. Person in car is supposed to make sure its safe to enter the road.
