Some help please!?



was involved in a minor accident on May 12, 2006. I was leaving my dentist office and there was an SUV on the right side of me (parked) so it created a blindspot for me. As I pulled out about 2 inches on to the sidewalk some yelled "stop" so I did. Then what seemed like an enturnity ( 5 sec) a lady popped up on my right hand side. The police came took a report, ambulance treated her and she rode away on her bike per the police report. Well I waited to get a police report and it states

CAUSE:

Hensen (the bicyclist) caused the collision by being in violation of 21650.1 VC by traveling on the wrong side of the road. She was also riding on the sidewalk when there is a bike lane.

Reccommendations: Forward to the Sutter County Traffice Division for issuance of notice of violation on Hensen.

I get a call from my insurance company today saying I am 50% at fault! I do not understand this at all!! When the only damage done and pictures were taken was the front passengers tire wall had a scuff mark from you tire. Can anyone please help with advice!!! thanks... Clinton

Sounds like you got caught by a insurance scam, get a good lawyer
your getting hosed!!
I am told Oregon has a no-fault law, which means no one can not be at fault (follow that?). So, unless you were not in your vehicle at the time of the accident, you are held responsible for some of the accident. Perhaps your state has a similar law. I know it's BS!!
I already answered this question yesterday, and so did many others.
