Can She do this? |
This summer my friend Candace's 10 year old daughter Cori was leaving my house on her bike and when she got to the corner there was a truck parked near the corner that she had to look around to see if anyone was comming, she did'nt see anything and headed across and got hit by a lady driving a truck, not hard enough to hurt her but hard enough to knock her off her bike,the lady got a small dent on her bumper from it, last week Candace got a letter from the lady saying that she was going after Candaces insurance for the accident, can she do that? It is not Candace's fault that the lady was'nt watching and hit Cori Yea, because this has a lot to do with diet and fitness. Try again. she probably can legally do that, but i wouldn't worry about that too much. i would send a copy of the letter to my insurance agent so they have it on record. that lady is crazy .... have your friend fight this .....she hit the pedestrian which has the right of way (and a child @ that!) ..... the little girl did not hit her!.... the judge will throw it out. Some people are so ignorant they'll sue for anything. I'm not sure but when whenever someone is hit a police report is required. If the woman didn't report it to the police it is considered a hit & run & she'll be in a lot bigger trouble than a dent in her fender. Check it out. Also, Candace had the right of way at the corner so the woman is SOL. Hope it all works out in Candace's families favour. What has this accident to do with diet and health? |
