Need help on a legal issue involving a minor running a bike into my SUV.. Any suggestions? |
A minor (10) ran his bike hinto my SUV, while it was on my property.. He then left it sittingh next to the SUV, and him and his friends ran up the driveway.. What kind of legsal issue do I have, and what can I do? I go an estimate on the SUV and the damage came out to be $1,000.. My insurance company said it would be treated as a collision It is highly doubtful that the kid has insurance. You can sue his parents, but I doubt you will collect on your own. Let your insurance company handle it. If you have the kid's name and address, the company might be able to find his parents and go after them. Otherwise, it will be treated as a hit-and-run. sue the kids parents The minor has committed an act of negligence, and is liable in tort for the damages he caused. Problem 1: Most minors don't have a spare $1,000. Problem 2: Most states don't make parents vicariously liable for their childrens' torts. Basic deal: If you sue, you likely won't collect anything. Sorry. First, I'd think defensively. It could be worse if the child's parents sued you for injuries to their child. Lawyers can always think up reasons you were negligent. Then your home owner's insurance would cover some liability, but not much and you'd need a liability "umbrella" policy for big lawsuits against you. So in my opinion you should be happy your auto insurance is covering the damage to your SUV. Might as well turn it in on your insurance. I dont know what kind of deductible you have - if any. I had a similar experience a couple years back with a kid who was only around 5. His parents would let him ride his bike in the street without even watching him. He slammed into my parked car, putting a 6 inch scratch down the fender. I call the police out, they take a report and told me my options. Drag it out in court or let your insurance pay for it. These people were your typical redneck drunk types-they didnt have a dime. I just turned it in on my insurance. The police did investigate the parents for neglet-i have no idea what became of any of that. First get your bill and confront the per ants, show them the bill. If they are good per ants they will step up to the plate. If not walk away and assuming you have all the evidence start legal procedure. Have a letter sent to them once they know they have to pay for all then they would think twice. the bill for the letter would be probably $50 add that to the bill. If you have no satisfaction this way go to small clams court. |
