Air ambulance causing damage to property.?


Okay.Before i begin i want to make it clear that the air ambulance is an important tool for saving peoples lives.
But today we had one land on our estate.Lots of emergency staff were asking people to move bins and cars so it could land in a tight area.I told one of the crew on the ground i would just go inside and get my motorbike keys so i could move it.I was told ok.But the staff waved the pilot in and my bike was blown over causing extensive damage.The impact was so hard the underseat storage burst open and my expensive crash helmet also was badly damaged.The steering,body work are very bad.
Clearly the pilot could not land without getting my bike out of the way.All the neighbours who watched this happen said so.
I know it was an emergency but surely this is criminal damage.
If the pilot could not land he should not have attempted too.
Will i be able to pursue this through my insurance company and make a claim for the damage.Or because it was an emergency i cannot.

Plenty of people witnessed the air ambulance turbulance knocking the bike over and said they would back me up with insurance if it came to that.

Most air ambulances are actually owned and operated by private companies. Find out who owned the ambulance that caused the damage. While the law varied by state, the damage should be covered by the ambulances insurance. Emergency vehicles are only protected from liability when they damage property that is illegally in the way, such as a car in front of a fire hydrant or if your motorcycle was parked on the helipad. However, there is no CRIMINAL liability. It is strictly a civil issue.

First you'd need to "prove" it.
File a claim.
But, simply because they have an emergency doesn't exlude them from property damage....i.e. blasting shingles off the roof with rotorwash.
I have never flown an air ambulance, but I have driven police cars, and if I damage something in a chase or trying to save someone's life, I was liable for it in the long run.
I would call your insurance company and see what they have to say.

Depends on the laws of your unidentified State.

In some States the government and its agents are immune from civil liability for damage that they cause while attending an emergency. (This is called "firebreak immunity" because the earliest examples of them were firefighters demolishing houses, or setting backfires, to make a firebreak to stop the spread of a fire)

You need to check your States laws.
