Bike Accident - Compensation ?

A Motorist pulled out in front of me when i was riding to work on my motorbike and i fractured my scaphoid.

The only way i can get reimbursed for my leathers and helmet is to take out a personnal injury claim against the driver.

Does anyone know or have experience of what sort of compensation you would expect to receive for this injury ?

Ask a solicitor, or one of those compo companies.

Rather, a number of simple factors such as the type of accident, related injuries, out-of-pocket expenses, medical costs and lost wages all go into determining how much a claim is worth.

What amount an insurance company is willing to pay actually falls into a fairly narrow spectrum.

2 1/2 tims your medical costs is common, I have no idea what you injured, so I can't begin to assume how much treatment you'll need to recover..or if your injury is permanant...
You can settle this yourself without an attorney and save yourself 1/3 of your settlement in costs...
Decline the first offer, they'll immediatly increase it say 500-1000 bucks, decline this and tell them you were hoping to resolve this without going to an attorney or going to court.... They will likely call you back with yet another offer... 2 1/2 ties your medical is your target...if you can do better great.
As for lost articles of clothing, that should be paid for in property damage almost immediatly is my experience, even before everything is settled...

When I was knocked off my bike I had legal expenses cover so my insurance company arranged the claim for me. Due to a minor injury I had to wait a year (after an initial and final medical examination) for the money, but the solicitor was also a motorcyclist so was able to view the offers made from my point of view. Amount of compensation depends on many factors, a solicitor is best placed to answer that question.

The cost of any required medical treatment that was the direct result of this accident.

Compensation for any days of work missed that were a direct result of this accident.

The cost of repairs to your motorbike, or if the repairs would be more than the fair market value of your bike, the fair market value.

*Perhaps* the depreciated cost of your leathers and helmet. Surely not replacement value.

*Perhaps* some token amount for pain and suffering. If someone tries to tell you there is a formula like "3 times medical", they have no idea what they are talking about.

Each case is looked at, and settled, on its own merit.

Your best source of what is fair and average regarding settlement will be your own insurance agent. Ask him.

Well said Ting Tong. I know there's good and bad drivers for all types of vehicles, but the general standard of motorcycle riding in regard to their consideration to other road users I see is appalling.
