if minor say X taken the motor bike owned by Y and came across accedent with other motor bike rider say Z of 35 years age ....in this case other motor bike rider caused head injury and died after a week ,who wont wear helmet ....X wear helmet and injured ........in above situation Y owner is out of district for his new posting and came to know after second day ....................MV act 1988 states that in any case leability to pay compensation is goes towards owner only....as minor cant get any punishement ........is it law or what ..................it like that if u park vehicle some one stole it and made some accedent and again park the vehicle as it is in hrs ....then as per law OWNER IS PUNISAHBLE ..........&&&&&&&& IS IT ETHICAL TO PUNISH THE INOSCENT BY THIS LAW
It isn't exactly ethical, no.
Sadly, there are many laws that are legal and yet not ethical since not every law can take into account every possible situation.
This is not to say it's right... just that it's the law. Fortunately there are some judges who work with the intent of the law rather than the letter of it. |
