Is it California law that when you are riding a bicycle, you must wear a helmet? YES, everyone under the age of 18 years old not 16 is required to wear a helmet in California. This is defined under the section 21212 cvc. The fine amount depends in what city or county the violation occurred when cited. Here is the actual California Vehicle Code law: 搂 21212. Bicycle helmets; wearing and selling helmets in conformance with law; violations and penalties; use of penalty collections (a) A person under 18 years of age shall not operate a bicycle, or ride upon a bicycle as a passenger, upon a street, bikeway, as defined in Section 890.4 of the Streets and Highways Code, or any other public bicycle path or trail unless that person is wearing a properly fitted and fastened bicycle helmet that meets the standards of the American National Standards Institute (ANSI Z 90.4 bicycle helmet standard), the Snell Memorial Foundation's Standard for Protective Headgear for Use in Bicycling, or the American Society for Testing Materials (ASTM F-1447 standard). This requirement also applies to a person who rides upon a bicycle while in a restraining seat that is attached to the bicycle or in a trailer towed by the bicycle. Because head injuries are the leading cause of death and disability for bicyclist, skaters, skateboarders and even scooters. The law was enacted Jan 1, 2003 and requires anyone under the age of 18 to use a helmet when using the above. only if you are less than 16 years of age.i recently found out some localities or townships have differing local regulations that do require them for every one. $20 fine if under 16. And it's not really enforced in most areas. Here in San Francisco, cops dont care if you wear a helmet or not. Most people dont wear helmets. |
